1. Agreement to these Terms
These Terms and Conditions (“Terms”) govern your access to and use of the Honest Cabinets website and any related services, consultations, digital deliverables, sample orders, and cabinet orders (collectively, “Services”). By accessing the website, submitting a form, booking a consultation, purchasing a service, requesting or accepting a quote, or placing an order, you agree to these Terms.
2. Definitions
“Honest Cabinets,” “we,” “us,” and “our” refer to the Honest Cabinets business and its representatives.
“You” and “your” refer to the customer, site visitor, or purchaser of Services.
“Order Documents” include written quotes, invoices, order acknowledgments, specifications, drawings, approvals, disclaimers, and related communications.
3. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date reflects the effective date of the current version. Continued use of the website or Services after an update constitutes acceptance of the updated Terms.
4. Scope of Services
Honest Cabinets provides a remote-first cabinet design and procurement experience that may include: design consultation, layout and planning guidance, 3D visualization, production-ready documentation (when included in your purchased package), sample products, cabinet ordering, and coordination support with your contractor or installer. Not all deliverables are included in every offering.
5. Quotes, specifications, and approvals
Quotes and recommendations are based on information you provide, including measurements, photos, site conditions, and selected products. You are responsible for reviewing and approving all specifications, selections, and Order Documents before an order is finalized. Any change after approval may affect pricing, lead times, and feasibility.
6. Measurements, site conditions, and project coordination
You are responsible for the accuracy of all measurements and site details provided unless we explicitly confirm we performed an on-site measurement service (if ever offered). Field conditions, out-of-square walls, floor/ceiling variations, and trade work (plumbing, electrical, HVAC, framing) can affect cabinet fit and installation requirements. You are responsible for ensuring your contractor and installer verify site conditions and coordinate required trade adjustments.
7. Design deliverables and reliance
Design deliverables are planning and communication tools and may be based on assumptions and standard construction tolerances. You and your contractor are responsible for verifying constructability, code compliance, and site readiness. We do not provide professional engineering or licensed architectural services.
8. Sample products
Sample items (including door samples or finish chips) may vary from final production due to normal manufacturing variation, wood grain and stain variance, lighting conditions, sheen perception, and batch differences. Samples are intended to guide decisions, not guarantee exact appearance.
9. Ordering, changes, and cancellations
Cabinet orders commonly involve made-to-order manufacturing. Once an order enters production, changes and cancellations may be limited or unavailable and may result in fees. Any applicable change, restock, or cancellation rules will be stated in your Order Documents and are incorporated into these Terms by reference.
10. Lead times, delivery windows, and delays
Estimated lead times and delivery windows are estimates. Delays can occur due to manufacturer capacity, supply chain constraints, shipping carrier performance, weather, damage replacement cycles, site readiness, or changes requested after approval. Unless expressly stated otherwise in Order Documents, time estimates are not guaranteed deadlines.
11. Pricing, taxes, and promotions
Prices may include product costs, design service fees (if applicable), delivery or shipping components, and other line items stated in your quote or invoice. Sales tax, if applicable, will be shown in Order Documents. Promotional pricing, if offered, may be limited in scope, duration, and eligibility and may be subject to manufacturer terms.
12. Payments, invoicing, and fees
Payments are due as stated in the invoice or Order Documents. Large transactions may involve additional verification steps for fraud prevention and payment processing. If you initiate a chargeback or payment reversal for an undisputed or properly delivered product or service, you agree to reimburse any associated fees and administrative costs to the extent permitted by law.
13. Shipping, delivery, and risk of loss
Delivery terms, access requirements, lift-gate needs, and site constraints vary by project and will be described in Order Documents. You are responsible for ensuring delivery access and safe receiving conditions. Responsibility for loss or damage may shift according to the delivery terms stated in your Order Documents.
14. Inspection, damage, shortages, and claims
You must inspect delivered goods promptly and report visible damage, concealed damage, shortages, or discrepancies within the time period stated in your Order Documents and/or carrier paperwork. Failure to report within the required time window may limit available remedies. Remedies, when available, typically include repair, replacement, or parts reshipment rather than refunds for made-to-order items, subject to manufacturer and Order Document terms.
15. Warranty and returns
Warranty and returns rules depend on the product line and the specific transaction terms. Warranty coverage, limitations, and the process for claims will be provided in your Order Documents and/or in our published warranty/returns resource materials. Where a manufacturer warranty applies, the manufacturer may set conditions and limitations. Any return rights, if offered, are subject to eligibility conditions and are generally limited for made-to-order cabinetry.
16. Installation and third-party services
Unless explicitly stated in writing, Honest Cabinets does not perform installation. Installation and jobsite work are performed by third parties under your separate agreement(s). We are not responsible for third-party workmanship, scheduling, jobsite safety, or code compliance.
17. Intellectual property
Website content, branding, text, images, and original design materials provided by us are protected by intellectual property laws. You may use deliverables solely for your project. You may not reproduce, publish, resell, or distribute our proprietary materials outside your project without our written permission.
18. Customer content and testimonials
If you provide photos, videos, reviews, or testimonials, you grant us a non-exclusive license to use them for business purposes (including marketing and portfolio use), subject to any written restrictions you provide at the time of submission. You represent you have the rights to share such content.
19. Prohibited use
You agree not to misuse the website or Services, including attempting unauthorized access, interfering with site operation, submitting false information, or using the Services for unlawful purposes.
20. Disclaimers
The website and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties not expressly stated in Order Documents, including implied warranties of merchantability and fitness for a particular purpose. Product appearance can vary due to materials, lighting, and manufacturing tolerances.
21. Limitation of liability
To the maximum extent permitted by law, Honest Cabinets will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost use, project delays, or contractor costs arising from or related to the website or Services. Our total liability for any claim will not exceed the amount you paid to us for the specific Service or product giving rise to the claim, unless a higher minimum is required by applicable law.
22. Indemnification
You agree to indemnify and hold Honest Cabinets harmless from claims, damages, and expenses arising from your breach of these Terms, your misuse of the website or Services, or your submission of inaccurate measurements or site information, to the extent permitted by law.
23. Dispute resolution
Before filing a claim, you agree to attempt to resolve disputes informally by contacting us through our Contact page and providing a written description of the issue and the relief requested. If the dispute is not resolved, any legal action must be brought in a court of competent jurisdiction located in the state where Honest Cabinets is headquartered, unless applicable law requires otherwise.
24. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
25. Entire agreement
These Terms, together with Order Documents and any published policies expressly incorporated by reference, constitute the entire agreement regarding the website and Services.
